What are Bad Checks?
Checks which are returned to you and stamped "NSF", "INSUFFICIENT FUNDS",
"ACCOUNT CLOSED" or other such stamp, are bad checks.
What can I do to minimize the number of Bad Checks I receive?
- Make it your policy to always look at the check writer's photo I.D.
- Be sure the photo matches the person who wrote the check and the signatures on
the check and on the I.D. match.
- Always write the number of the identification and its type on the check.
- Get a complete, current address.
- Make sure the figure and written amounts match.
- Ask questions of the check writer if something doesn't match up or something
just doesn't feel right. You are not obligated to accept a check.
What action can I take if my bank returns a Bad Check to me?
The District Attorney has recently established a Bad Check Restitution Program.
Here are some of the guidelines for that program:
- The amount of the check or checks (from a single individual) must not be more
than $1000 (no minimum).
- The check must have been received in Larimer County.
- The check must be submitted to the program no earlier than 31 days but within 90
days from the date on the check.
- A photo I.D. (driver's license, military I.D., state identification card) was
recorded at the time of the transaction.
- The check must be deposited twice (except on a closed account).

If your bad check totals more than $1000 or exceeds the time limit, then you may
submit it to the Larimer County Sheriff's Office for investigation. Contact the
DPR Unit at 970-498-5111 to request the necessary forms and information.
